PRIVACY POLICY
Based on the Albanian Law no. 9887, dated 10.03.2008 “On Personal Data Protection”, as amended and/or other applicable data protection laws, bylaws, guides, decisions, etc. enforced in Albania (altogether, the “Data Law”), and also based on our ethical responsibility as legal professionals, Frost & Fire Consulting (“FFC”, “we”, or “us”) has drafted this privacy policy statement (“Privacy Policy”), through which we would like to inform our prospective clients, job applicants, or other relevant third parties (“Data Subject”, or “you”) on the purpose and means of collecting and processing their data, duration of the processing, the data protection rights of the Data Subjects, as well as other matters listed below.
The data protected also includes data not provided directly by the Data Subjects, but also data provided by third parties for the Data Subjects.
1.Purpose and Means of Data Processing
FFC may collect and process your personal data for the following purposes:
- To contact and respond/inform you about your requests or enquires;
- To organize the recruitment process and to inform job applicants about such process;
- To provide you our legal services and administer every process related with the legal services;
- To enter into, or carry out various kinds of agreements;
- To comply with other legal requirements in relation to the services we provide.
- To organize legal or business events; and/or
- For other business, networking, or marketing purposes.
We collect and process your data based on your consent, legitimate interest of FFC or any relevant third party, and/or fulfillment of a contract to which the subject of data is a contracting party, as the case may be.
This collection and processing concerns data which may be mandatory to be collected or processed by the applicable law, or data voluntary given by the Data Subjects. FFC will collect and process the data for the best and proper fulfillment of the services we provide to the Data Subject and of the purposes listed in this Section.
2.Confidentiality, Security Systems, and Retention
Unless as otherwise provided in this Privacy Policy under the “Disclosure and Transfer of Data” Section below, by the Data Subject, or unless the data becomes available in the public domain or is already disclosed by the Data Subject and/or other third parties not related to FFC, all data collected and processed by us will remain strictly confidential.
All data will be secured, protected and stored in accordance with the Data Law and the appropriate practices in the industry.
We may retain the data provided by you, for as long as necessary to:
- Comply with our legal obligations; and/or
- To achieve the purposes for which the data was originally collected.
We may also retain the personal data to process them considering future transactions with the Data Subject. If you wish to obtain more details regarding the information mentioned under this Section, please refer to the “Contact Us” Section below.
3.Disclosure and Transfer of Data
We may disclose your data to third parties. Such disclosure will only be limited to the services we provide to you, whether it is a legal requirement for the fulfillment of the services provided, or as directed by the Data Subject. While we require each third party to fulfill their data protection obligations, we will not be held responsible for the fulfillment of third parties’ obligations regarding the data collection and processing on their part, unless otherwise determined by the Data Law. The Data Subject may contact third parties directly for any request they might have in relation to the collection and processing of their data from these third parties.
4.Data Subjects’ Rights
Under the Data Law, the rights of the Data Subjects include the following:
- The right of access;
- The right to ask for the deletion, blocking, correction of the data;
- The right to not be subject to automated decision-making, including profiling (if applicable);
- The right to receive the personal data provided to FFC, in a structured, commonly used and machine-readable format, and have the right to transmit those data to another controller without hindrance from FFC;
- The right to refuse the processing of personal data at any time;
- The right to complain to the supervising authority; and
- The right to be compensated in accordance with the Albanian Civil Code.
- Please note that we do not cover any cost or provide any service if you wish to exercise your right mentioned under point “f” and “g” above.

5.Rights Under the GDPR and Other Foreign Legislation
Under the EU’s General Data Protection Regulation (“GDPR”) or based on the applicable legislation in the foreign jurisdiction of the Data Subject, FFC may be subject to certain obligations towards foreign Data Subjects. While we stay committed to fulfill these obligations (if applicable to us), we recommend you engage a local lawyer/consultant in your foreign jurisdiction if you wish to be more informed about your rights mentioned under this Section, and to collaborate with us for the fulfillment of these rights.
6.Changes and Additional Information
We reserve the right to change this Privacy Policy at any time and in accordance with the Data Law. Any changes or additional information will be posted on this website and/or on any other platform we deem appropriate, such as in the engagement letter, or any agreement we may sign with you.
